Probate is necessary even with a Will.  A Will only informs the court of your loved ones assets and who gets what.  It does NOT avoid Probate. 

Probate enables us to retitle assets into the names of the individuals. For example, your parent owned a house. That house was under the name of your parent. It now needs to be transferred to your name. That is what probate handles.
